‍We, at Fyno, care about Your privacy and the Personal Information provided by You.

This Privacy Policy (defined below) explains how Intelligent Acumen Technologies Private Limited or any of its affiliates or subsidiaries, (hereinafter referred as “Company”, “Fyno”, “We”, “Us” or “Our”) processes Personal Information collected from You.

This Privacy Policy explains what Personal Information We collect, how We collect, how We use and share that data, and Your choices concerning Our data practices. 

Before using the Fyno Solutions, please review this Privacy Policy carefully and contact Us if You have any questions. By using Fyno Solutions, You agree to the practices described in this Privacy Policy. If You do not agree to this Privacy Policy, please do not access the Website or otherwise use Fyno Solutions.  For the purposes of this Privacy Policy the term “You/you”, “Your”, “Yourself” shall mean any identified or identifiable natural person whose Personal Information We process as a Controller as mentioned in Clause 1.1 of this Privacy Policy.

Please note that the capitalized terms not defined under this Privacy Policy shall have the same meaning as assigned to such terms in the License Agreement.  

1. Definitions

1.1. “Controller” means the natural or legal person, public authority, agency, or other body which alone or jointly with others, determines the purposes and means of the processing of Personal Information.

1.2. “End-User(s)” means any person or entity other than the Subscriber or the Authorized Users whose data is transmitted by or on behalf of the Subscriber to the Fyno Solution.

1.3. “License Agreement” means the agreement which governs Subscriber’s access and use of the Fyno Solutions.

1.4. “Personal Information” means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

1.5. “Processor” means a natural or legal person, public authority, agency, or other body which processes Personal Information on behalf of the Controller.

1.6. “Subscriber” means the person that has subscribed to Fyno Solutions by entering into an Agreement.

1.7. “Website” means the websites that We own and operate, including https://fyno.io/.

2. What Personal Information do We collect?

d. An Authorized User who logs-in to Fyno Solutions using the third-party sign-on service.In case You log-in using any third-party sign-on services, such information as available on those third-party services that You have made public or authorized to share with Fyno.
  1. Verification of an Authorized User’s identity and help an Authorized User log into Fyno Solutions.
  2. To communicate with an Authorized User regarding existing products and services availed by the Subscriber including notifications of any alerts or updates.
  3. To send an Authorized User information about Our other products or services, events, webinars, or programs that may be of interest to such Authorized User, in compliance with applicable data protection laws. 
Third-party applications that enable logging in to Your Account, sending You notifications and information about Our products, services, Fyno Solutions, webinars, etc.

2.3. If You provide Us with any Personal Information relating to other individuals, You represent that You have the authority to do so, and where required, have obtained the necessary consent, and acknowledge that it may be used in accordance with this Privacy Policy. If You believe that Your Personal Information has been provided to Us improperly, please contact Us by using the information in Clause 13 below.

2.4. In addition to the details provided in the table above, We may also share Your Personal Information with:

  1. an entity to which we divest all or a portion of Our business, or otherwise in connection with a merger, consolidation, change in control, reorganisation or liquidation of all or a portion of Our business.
  2. Law enforcement authorities, government authorities, courts, dispute resolution bodies, regulators, auditors, and any party appointed or requested by applicable regulators to carry out investigations or audits of Our activities.
  3. Professional advisors who advise and assist Us in enforcing Our contracts and policies, handling Our claims, effective management of Our company and in relation to any disputes We may become involved in.
  4. credit reference agencies and use the resulting information to prevent fraudulent purchases.


3. Legal Basis For Processing Personal Information (EEA And UK)

3.1. If you are from the European Economic Area (EEA) or United Kingdom (UK), Our legal basis for collecting and using Personal Information described above will depend on the Personal Information concerned and the specific context in which We collect it.

3.2. We will normally collect Personal Information only where it is needed to perform a contract with You, where the processing is in Our legitimate interests and not overridden by Your data protection interests or fundamental rights and freedoms, or where We have Your consent. In some cases, We may also have a legal obligation to collect Personal Information from You. If We process Personal Information with reliance on Your consent, You may withdraw Your consent at any time.

4.1. Cookies are text files that are placed on Your computer to collect standard internet log information and visitor behaviour information by Us. When You visit the Website(s), We may collect Personal Information automatically from You through cookies or similar technology. 5.2. The right to rectification - You have the right to request that Our Company correct any Personal Information you believe is inaccurate. You also have the right to request Our Company to complete information you believe needs to be completed.

5.3. The right to erasure - You have the right to request that Our Company erase Your Personal Information, under certain conditions.

6. Security of Personal Information

6.1. We use appropriate technical and organisational measures to protect the Personal Information that We collect and process, in compliance with the relevant applicable laws, including internal reviews of data collection, storage and processing practices and other reasonable security measures. We have in place a secure server for all Your Personal Information which, if required to be accessed, are accessible only by Our authorized personnel. 7. Exclusion

7.1. End-User Exclusions. Fyno Solutions is intended for use by businesses. This Privacy Policy is not applicable to Our processing of any Personal Information forming a part of the Client Data. We may receive End-Users’ Personal Information as a part of the Client Data for which We will only act as a Processor and such processing will be governed by the Agreement. In such a case, the End-User’s data privacy questions and requests should be submitted to the Subscriber in its capacity as a Controller. We are not responsible for Subscribers’ privacy or security practices which may be different from this notice. Subscribers of Fyno Solutions are solely responsible for establishing policies for and ensuring compliance with all applicable laws and regulations, as well as any and all privacy policies, agreements, or other obligations, relating to the collection of Personal Information in connection with the use Fyno Solutions by the Subscriber.

7.2. Link to third party sites.  Our Website may provide third party information and links to other platforms that are not affiliates of or operated or controlled by Us including but not limited to payment gateways or social networking platforms. We are not responsible for any form of transmission, whatsoever, received by You from any third-party platform and accordingly do not make any representations concerning the privacy practices or other policies of such third-party platforms. Under no circumstances shall We be deemed to control or guarantee the accuracy, integrity, or quality of the information, data, text, software, sound, photographs, graphics, videos, cookies, messages or other materials available on such platforms. Any information provided by You to such third-party platforms shall be governed in accordance with the privacy policies of such platforms and it is recommended that You review the privacy policy of such platforms prior to using such platforms.

8. Retention of Personal Information

8.1. Once you delete your Personal Information through your account settings such as name and e-mail address on the Website, this deleted information is not stored in any form at our end. We retain Personal Information collected only where an ongoing legitimate business requires retention of such Personal Information such as to defend or pursue legal claims, to fulfil any surviving obligations arising from a contract, to provide You with information regarding Our products or Fyno Solutions, or to comply with any legal, tax or accounting requirements. Our data retention policy specifies that the data stored in the form of logs on our application, will be maintained for a period of 6 months from its generation and subsequently destroyed. In the absence of a need to retain Personal Information as described above, We will either delete it or anonymize it, or, if this is not technically possible then We will securely store Your Personal Information and isolate it from any further processing until deletion is possible.

8.2. You have every right to cease to hold an account with us. However, the past activity data associated with your account is intact in anonymous form with us and we may utilise it for research and analysis purposes in order to improve the quality of Fyno Solutions.

9. International data transfer

9.1. We mainly process Personal Information in India. However, We may transfer Personal Information outside these regions only for the purposes referred to in Clause 2. We will ensure that the recipient of Your Personal Information offers an adequate level of protection that is at least comparable to that which is provided under applicable data protection laws.  

9.2. If You are a resident of the European Economic Area and when We may share personal data and information with the entities situated outside the European Union. We ensure that your Personal Information is protected and the data recipient adopts an adequate level of data protection, for instance by entering into standard contractual clauses for the transfer of Personal Information as approved by the European Commission (Article 46 General Data Privacy Regulation, 2016), or We will ask You for Your prior consent to such international data transfers. 

10. Children’s privacy protection

Fyno Solutions is not for or directed towards children. While We do not intend to and will not knowingly collect any Personal Information from children under the age of eighteen (18) years. Children under the age of eighteen (18) years are prohibited from using Fyno Solutions. If we learn that we have collected information from a child under the age of eighteen (18) years, we will remove that information without undue delay and delete it from our servers (subject to applicable law and this Privacy Policy). If you believe Personal Information from a child under the age of eighteen (18) years has been, shared with us please notify us by contacting us at support@fyno.io.

11. Change in privacy policy

In the event there are any changes to this Privacy Policy or in the way we treat any Client Data, We will also display a notice on the Website regarding the above. If after your receipt of a notice of change to the or Privacy Policy you continue sharing Personal Information with Us, you will be assumed to have  agreed to the updated Privacy Policy.
